Legal tips for travelling and living in Jamaica

Traveling to Jamaica can be difficult, especially when you are unaware of your rights. Difficulties at times present themselves only after you’ve decided to stay on in the country for extended periods, of say more than two weeks. Even more challenging is the onslaught of high prices, where you do not beforehand equip yourself with knowledge. This goes for residence of any kind.

Rest assured though you can have fun, legally as you explore Jamaica’s culture through living like a Jamaican – something that tours do not offer.

An easy way of understanding Jamaicans, is by visiting one of our courthouses for a day. Whatever the case especially in the Resident Magistrates Court, humour is a definite side order as even Jamaicans themselves get educated through their own court experiences.

The three most popular courthouses are in Kingston. Both the Resident Magistrate’s Court (court at first instant and for small claims) and the Supreme Court (highest court) are located in downtown Kingston, while the Criminal Court is in the Half-Way-Tree area.

If allowed, you may want to indulge in spending a day with a police officer, especially a traffic cop. Definitely amusing as Jamaicans exercise their “intellect”, while some officers try to earn an extra dollar on the streets through an illegal hustle. But there are good cops and it would be in your best interest to know the difference. More importantly, know your rights so that you can avoid a hustle or illegal hassle.

Either way it would suit you to know your rights – your shield against crafty Jamaicans.

AS a start visit the website of the Ministry of Justice and explore the laws of Jamaica. Be aware though that, as unique as our culture is, so too is the application of the laws.

You may find that a number of the existing laws are not being practiced or upheld as written. Even more exciting is the slant to a few of them. One such example is the relationships between landlords and tenant, mostly due to the fact that there are far more tenants than landlords. Landlords have a field day, while some delinquent tenants give them reason to. There is some serious price gouging going on, and allowed only where persons do not educate themselves on their rights, regardless of the length or nature of your stay.

My advice on this is that you get involved with the Rent Assessment Board from DAY One of your planning on living/staying in Jamaica, however temporary.

A case in Court may take years to resolve, so prevent the headache by first empowering yourself through contact with the Rent Board. Currently they have two offices. Their New Kingston office number is 501-2905.

Bear in mind that although laws are being amended it would suit you to make good preparations whether independently or with the help of a lawyer should you have a case in court.

A legal experience with lawyers is an entirely different story, but research is a MUST before securing one ESPECIALLY in Jamaica.

The Bar Association of Jamaica is a good point of contact, but they wont advise you on which lawyer to choose.

Three good lawyers are Alexander Williams (civil), Colonel Linton Gordon (criminal) and Paul Beswick. Dwane Forbes, although not an attorney-at-law works very well as a paralegal, and can assist with legal paperwork. Owning over 12 years experience as a paralegal, he currently manages the office of Lightbourne and Hamilton. All are excellent also in any cases involving large sums of money.

Judges especially at the Resident Magistrate level can be quite emotional and thus persuasive in securing consent for a number of cases thus reducing the need for trial. However a sound knowledge of the law yields great rewards, as you may find that initial consent is not the best way especially when responding to a claim by scheming Jamaicans.

You may find that more than your ability to argue, is the need to rely on your own good sense of judgment and logic.

Sure we all have that little niggle at the back of our minds when we set of to travel with friends, what if we fight, or what if we can’t stand each other after a week!? Well here are some tips to help prevent nasty split ups along the way.  

Most of us will at one time travel with a friend or friends, if we are avid travellers. Solo travel is fun, but having a buddy there to share all those amazing moments, and talk about it when you get home is pretty special too. We all have a bad habit or two, and of course our friends generally have their own little idiosyncrasies as well. Having travelled quite a lot with friends, been a tour guide and having to get along with many different personalities, I am here to impart some basic wisdom to help you and your friend have a smoother holiday. It’s all up to you in the end.

Tip one: Space, sure we love being in each other’s pockets, it’s all very exciting, but if you don’t give yourself and your friend at least one day of free me time every so often than things may get stuffy. Remember you both may want to do something the other does not, this is the perfect opportunity to get out and do something solo, one may want to take a bike ride along the coast, and the other may want to sit back and relax in a day spa getting a massage and mud bath. Don’t procrastinate about it if you can’t agree, take the day off from each other and go do something separately. You’ll find you have loads to talk about on your return and you won’t be frustrated you missed out.

A separate room every now and then can also work like magic. If you’re having trouble sleeping, or your friends a bit messy and you’re a neat freak. Actually discuss the idea with your friend before heading off, most times you will share to conserve money, but every now and then splash out as a treat and have a room to yourself.

Tip two: Accept your differences. Yes we are all guilty of it, screwing up our noses at our friend’s choice of dress, dining spot or chosen activity for the day etc. You’re not going to make it through the trip if you can’t shake off your judgement, your friend has the right to be who he or she is, and getting worked up over what he or she is not doing, or is doing, is only going to make both of you frustrated and your holiday stressful. Always have a good book with you, or an inquisitive mind, if it’s all too much then head off down the beach to read alone, or explore the alley shops.

Tip three: Speak up. Your friend is not a mind reader, you know why you’re frustrated, but they probably don’t. A scheduled ‘how is the trip going thus far’ chit chat would go far, bring up what’s irking you and give them the opportunity to speak up as well. It’s not all about you after all. Try to work out a solution. Make sure if you are simply just feeling down or homesick, they know it’s not them, because they probably will think they have done something wrong if you’re just feeling blue and not explaining the reason, even if it’s just a brief one.

Tip four: Enjoy each other’s company and compromise. You must have travelled together for a reason, try to remember you are great friends after all the emotion of travel if scrapped away. Keep in mind that senses are heightened whilst travelling; things seem bigger than they actually are, and small issues can feel humungous. Try to peel back everything and look at it for what it is. Try to compromise an activity, your friend may want to do something that you don’t really and vice-versa. You may actually find you get something out of it, so give it a go, and don’t be a drag and go out of your way to show your not into it, this is their holiday as well and they have the right to choose a few activities for you both to do, they in turn will come along with you on your ultimate choice of things to do for the day.  

Remember it is what we make it, so make the most of it, because most people don’t get the opportunity to travel the world with a great friend.

You Need to Know When Travelling With Kids

One of the factors you need to be aware of is the “change of circumstances. When you travel, especially on long trips, there are many new and unfamiliar circumstances.

You have not sleep the beds, they do not eat, sit at their place at home. If you notice, even at home he will be in the same dining chair for every meal. This gives them a feeling familiar and comfortable. So, if you raise your children in a completely new environment that they find it difficult to undertake.

Food

Another potential problem is that kids do not eat their regular meals, especially when traveling abroad. This can be a child who is usually mean a good eater stormy and refuses to eat at all.

To defuse the situation, try to time their food as much as possible and look for foods that they usually prefer to keep to.

You can also start introducing them to new foods at home that they can experience during their trip. It is a good idea to inform them of the amazing new things, they will try to upset.

My friend Katie did exactly that before 4 years of age to Greece. Approximately 3 months before her flight she had a “Greek Night”, even if it had olives in the week, souvlaki (which is basically just delicious meat on a stick), Greek salad, tzatziki joys (yogurt-cucumber dip) and other. At the time her daughter came to Rhodes, she felt proud that she knew the names of serving Greek dishes, and she was confident of what they ate.

If you are in a position to have a food back up plan by packing some of their favorites. This may not always be possible if your trip overseas, where strict quarantine regulations.

Jetlag

Due to jet lag, or a situation in which the child does not have the comfort of their own bed, it is likely that they can not get enough sleep. If the children are deprived of sleep, you know, it is usually trouble. You get irritated with little provocation, and they are less able and willing to adapt to new environments.

Consider planning your journey times and bring it into line with naps and nighttime sleep, so that the whole family “internal clock” does not suffer.

Boredom

It is an important area that many parents do not address and that, as one with a lot of boredom! Every parent dreads the question: “Are We There Yet?” As is usually the beginning of the end of the moderate behavior of signals.

You need to understand that children do not always feel like the things you do. For example, you can enjoy the beauty of a long scenic drive, but get your child still appreciate nature.

If your child is bored, they do not know what they want. It is recommended to prevent your child from reaching that stage. If your child loses the desire is to stop it, to enjoy the things that they normally like to do.

This means that you will have almost an entire extra day to spend time relaxing.

While off-season ticket prices are typically affordable, trying to find an elusive plane ticket home during the week of Thanksgiving or Christmas without breaking the bank is akin to search for the lost city of Atlantis. The Best Way To Choose A Travel Guide Book

When you start looking for a travel guide book, it can be a little bewildering. There really are as many types of guide books as there are types of travelers. Where do you start to find the right one for you?

Traditional guide books make up the largest chunk of your selection… and there are plenty of these. They usually contain lots of good information, some black and white maps, key areas to see, and diagrams of significant buildings. You’ll usually find a few color pictures and maps too.

Think about where you’re going….

Are you doing the Grand Tour of several European counties? There are travel guide books that cover whole countries, and some that cover whole continents.

Are you going just to London and Paris? There are some books that cover just specific cities or areas.

Some will combine two or three neighboring countries like Southeast Asia with Thailand, Laos, Cambodia and Vietnam all in one book.

Choose the guide book that will suit your trip. No need to carry that “continent-of-Europe” tome around if all you’re seeing is a couple of cities. Two slim city guides will do and be so much easier to pack and carry.

Some guide books are far more visual than others. They tend to have lots of pictures and less information. The information is good, just not as in depth as other guides. If you’re taking a quick trip somewhere, those pictures can tell you in an instant if something looks like what you want to see…. they’re really enticing. And if it’s a quick trip, you probably don’t have time for long detailed explanations anyway.

There are lots of specialty guide books. These won’t give you as much general information, but if you have a special interest, it might be worth carrying one along. You can find specialty books for birdwatchers, or wine tasters. There are books that specialize in fancy restaurants.

There are whole books on castles to stay in or luxury spas. Guides to gardens or camping spots or great hiking trails. If you have a special interest, look online and visit travel bookstores… you’ll probably find a specialty guide in just the field you’re interested in.

Digital guide books are coming… well, some are already here. The publishers are still trying to figure out the best way to handle this. Some guides can be downloaded and read on your mobile phone… but those little screens make for eye strain when you’re trying to read a map or the fine print in those descriptions.

You can down load some onto your laptop, but carrying your laptop all day will be a drag. You can download them and print them out, but then you might as well take a published guide book.

Keep your eyes open for digital guides in the future though. Once some of these paperback sized reading devices become easier to carry around, you’ll be able to download just the areas you want, the specialties you want, and link to GPS technology.

Never get lost? I don’t know. Sometimes part of the fun of travel is getting lost and having great experiences you didn’t expect.

So for now, choose the type of printed travel guide book that will work best for you, and enjoy your trip.

There really isn’t a single series that will cover everything for every trip. You might even find you like certain things about two different guidebook series. Well, why not buy them both? You don’t have to carry them both around you know. We’ve even heard of people who cut them up…. while we, personally, have a hard time with dissecting books, it’s really not a crime.

Take the sections with you that you need. Cut them up into little sections so you can take just the sightseeing notes you need for the day. If you really want that book for a souvenir of your trip, buy two copies and leave the whole one at home.

Even if you’re a budget traveler, go ahead and spend wisely on a travel guidebook… a good one will SAVE you money on your trip.

Check through several different guidebooks. Do they cater to luxury travel? Can you afford the hotels and restaurants they’re recommending? Are they talking to backpackers and college kids? Do they list mostly hostels and cheap hotels? Get one that recommends accommodations that fit your budget.

See who has written the book, and what their expertise is in the region. Has the author traveled often in the area? Does he or she write in a style that makes you want to go and see these things for yourself? Have they checked out the hotels, eaten at the restaurants?

If one book has things like long, scholarly explanations about the foundations for castles, and you’re just not interested in that…, you might want to look for a different guide. Maybe something with lots of pictures to fire your imagination.

You can check some out of your local library and take your time looking at them, but also go to a large bookstore or one that specializes in travel so you can check out a really large selection of guides. If you find one that makes you feel like you can’t wait it get THERE and see THAT, then you’ve probably found the right one for you.

Once you’ve found the right one, or two, that will work for your travels, make sure you get the most current edition available and relax…. you can’t make a wrong decision. Any good guidebook will be a help.

European traveling: recession style

As the old saying goes: one’s problem is another’s opportunity. Global slowdown is still here and traveling industry reports decreasing amount of travelers, both globally and locally in the Netherlands. It is my educated assumption that this winter will be challenging for the industry. To the last one hotels, airlines and agencies arrived with some profits and money to spend and some fat for cutting. To the coming winter firms are approaching lean and after a year of struggling.

However, travelers can expect nothing less than paradise in terms of prices and deals. The industry is aware of the global situation and sees the reservations for the winter. The picture looks glum and people are still cutting on their expenses. The industry reacts with almost hysteric deals and attractive offers that are not being picked up as hoped.

Few examples I saw these days:

European flights costs are hitting rock bottom. One can find flights from the Netherlands to Prague for less than 40 Euros including all taxes.

Amsterdam hotels are offering package deals more than ever and three stars hotels rooms are being sold for less than 50 Euros a night. Five stars hotels offering rooms for less than 90 Euros.

If you are looking for a short vacation or a business trip, now is the time to plan it. When booking more than just few days in advance one can find deals he or she cannot refuse.

As opposed to last few years, I suggest travelers, especially in Amsterdam, not to opt for the cheap hotels but to indulge themselves in luxury hotels for a very reasonable price.

Business travelers had never a better time. They get much more for their money now in Amsterdam. More upgrades, more options included and much better service.

Hotels in Amsterdam are notoriously known for past high prices they used to charge, however a combination of changes including global recession are pushing said prices sharply down in Amsterdam.

 

As I said, this is definitely time to book and travel.
